How Long Can a Debt Be Chased?
To properly recover debts in New Zealand, the debtor must first be given notice of the debt they owe, what the debt is owed for, and when payment is needed.
Debtors must be given a reasonable amount of time after they receive notice of the debt to then pay the amount owed. We will also do our best to ensure repayment is easy for the debtor by presenting them with repayment options that best accommodate their financial position.
How is Money Collected from Debtors Who Can’t/Won’t Pay?
If the debtor fails to respond to their debt notice after a reasonable period of time has passed, we can proceed with court action to acquire an order for payment. This can legally enforce debt repayment to allow the creditor to recover what they are owed.
Once an order for repayment has been obtained, the debt may be recovered through the following orders:
- An order for examination
- An order for a repayment schedule
- An order for garnishment
- An order for liquidation/bankruptcy
